U.S. Court granted a marriage dissolution decree without the signature of an officer of the court, is this valid?
The Superior Court of California-Orange County-grant Decree AS IMPORTANT as a decree of dissolution of marriage without the signature of the Authorized Officer. It only takes Rubber Stamps "Clerk." When personal of inquiry if the signature can be obtained even in the payment of some extra-expenditure was made in the Court-no response was forthcoming SATISFACTORY. If a new marriage required to be carried out in some other country, this will not be considered a valid decree. Therefore, this new marriage can not be registered there. Even Notaries in that country refused to notarize the Phtocopies of the original decree and is unsigned. Even in the U.S., all important documents / Contracts / MOUs, etc, need to be signed. Will U.S. Courts accept any other documents that are unsigned IN ANY OTHER QUESTIONS? Is there any recourse?
I am a bit confused … In my country, it is common that the judge will sign the original document (which is kept on file with the Court of Auditors), and the endorsed copies (which are provided to the Court for distribution to the various parties involved .. That is what we provide .. YOU) are simply sealed by the secretary of the court with the judges name, seal, and endorsed. In my country, the two copies are perfectly legitimate as long as the seal is a seal of approval is received. About the need for a certified copy of the signed original .. for the application to re-marry in another country … that makes sense, since only accept a "practice" here to accept the copies sealed with original annotations. If you go to the Clerk of the Court, must have an original signed copy in case file. If not then you can request that the matter be placed on the calendar of the court and say what the Court that you need. The court will probably be happy to make this right for you, if the original was in fact never signed. Moreover, there will be an order of minutes attached to the copy of the solution that has received, showing the order made by the Court .. ie if there was a hearing …. If so, you can get a visa original copy of the decree and a certified copy of the order of minutes … also could be heavier than what apparently taught them. They are trying to protect people against forgery. so the approval and certification seals must be original stamps … you can not take the copy provided to you probably have an original endorsement stamp on it, and simply make a copy and use as test.
